Terms of Use

The short version
  • Burge shows you a short list of well-rated places. The place information comes from Google Maps — we can’t guarantee it is accurate or up to date.
  • Rankings are calculated automatically. Places do not pay to appear or to rank higher.
  • Burge Premium is a subscription billed by Apple or Google. You cancel it and ask for refunds there.
  • Please don’t scrape Burge, abuse the free searches or interfere with the service.
  • On iPhone, the app is licensed to you under Apple’s Standard EULA; these terms add to it.
  • Nothing here takes away rights you have under the consumer law of the country you live in.

1. Who we are and what these terms cover

Burge is run by Cihan Mert Bayam, an individual developer based in Türkiye (“we”, “us”). These Terms of Use apply to:

  • the Burge mobile app for iOS and Android (the “app”);
  • the website at burge.app, including its beta sign-up and support forms (the “website”);
  • beta versions of the app distributed through Apple TestFlight.

Together we call these the “service”. By using the service you agree to these terms. If you do not agree, please do not use it.

How we handle personal data is explained separately in our Privacy Policy.

2. The app licence

iPhone and iPad. The app is licensed to you under Apple’s Licensed Application End User License Agreement (the “Standard EULA”). These terms add to the Standard EULA. If the two conflict about your licence to use the app, the Standard EULA wins. Section 13 contains further terms that apply to the App Store version.

Android. We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the app on devices you own or control, for your own non-commercial use, in line with these terms and the Google Play terms.

You may not copy, modify, distribute, sell or lease the app, or try to extract its source code, except where the law expressly allows it.

3. Who can use Burge

Burge is not directed at children under 16. If you are under the age of majority where you live, you may use Burge only with the permission of a parent or guardian.

4. Your account

  • When you first open the app, an anonymous account is created for you automatically. You don’t need to give us your name or email to use Burge.
  • You can optionally sign in with Apple or Google. Signing in keeps your liked places and subscription when you change phones, and is required to subscribe.
  • You are responsible for activity under your account and for keeping access to your Apple or Google account secure.
  • You can delete your account at any time in the app: Profile → Delete my account. Deleting your account does not cancel a subscription — see section 6.

5. Place information, rankings and Google Maps

Burge includes Google Maps features and content. Use of Google Maps features and content is subject to the then-current versions of the Google Maps/Google Earth Additional Terms of Service and the Google Privacy Policy.

  • Place names, ratings, reviews, photos, addresses and opening hours come from Google. They belong to Google and its licensors, and may be incomplete, out of date or wrong. Always check important details (opening hours, accessibility, allergens, prices) with the place itself.
  • Burge’s lists are produced automatically from public ratings and the number of reviews. A ranking is not a recommendation, endorsement or guarantee of quality, safety or hygiene.
  • Places do not pay us to appear in Burge or to rank higher, and we are not affiliated with the places shown.
  • You visit places and follow directions at your own risk. Pay attention to your surroundings and follow local laws.

6. Free searches and Burge Premium

6.1 Free use

Burge includes a limited number of free searches. The number shown in the app is the one that applies. We may change free limits and features over time.

6.2 Burge Premium

  • Burge Premium is an optional, auto-renewing subscription that raises your search allowance. The price, billing period and allowance are shown in the app before you buy.
  • You buy Premium through the Apple App Store or Google Play. Payment, renewal, cancellation and refunds are handled by them under their own terms. We do not see or store your payment details.
  • The subscription renews automatically unless you cancel it at least 24 hours before the end of the current period. You cancel in your Apple or Google subscription settings. Deleting the app or your Burge account does not cancel it.
  • Refund requests go to Apple or Google, under their refund policies and any rights you have under local law.
  • If we change the price, Apple or Google will tell you in advance, as their rules require.
  • To protect the service, technical safeguards against automated or abusive use apply to all accounts, including Premium accounts.

7. Acceptable use

When using the service, you agree not to:

  • scrape, copy, store or republish place information from Burge, or use bots, scripts or other automated means to access the service;
  • try to get around search limits, for example by creating accounts or resetting devices to get more free searches;
  • reverse engineer the app or our servers, probe them for weaknesses without our permission, or interfere with their normal operation;
  • use the service for anything unlawful, or in a way that breaks Google’s terms mentioned in section 5;
  • send spam, malicious content or false information through the website forms or the feedback feature.

8. Beta versions

Beta versions are distributed through Apple TestFlight, and Apple’s TestFlight terms also apply to them. Beta versions are provided “as is” for testing. They may contain bugs, lose data, change without notice, stop working or expire, and the beta programme may end at any time. Please do not rely on a beta version for anything important.

9. Feedback

If you send us ideas, suggestions or feedback, we may use them to improve Burge without any obligation to you. This does not give us any rights to your personal data beyond what the Privacy Policy describes.

10. Our intellectual property

The Burge name, logo, app, website and their design and code belong to us. These terms do not give you any rights to them, other than the licence to use the app described in section 2. Google content and trademarks belong to Google and its licensors.

11. Availability, changes and termination

  • We work to keep Burge running, but we do not promise it will always be available, error-free or offer any particular feature. The service depends on third parties such as Google, Apple, Supabase and Cloudflare.
  • We may change, suspend or discontinue all or part of the service. If we discontinue Burge Premium, we will tell you in advance where we reasonably can, and stop renewals.
  • We may suspend or end your access if you seriously or repeatedly break these terms, or if we are required to by law. Where reasonable, we will tell you why.
  • You can stop using Burge at any time by deleting your account and the app, and cancelling any subscription.

12. Disclaimers and limitation of liability

The service is provided “as is” and “as available”. To the extent the law allows, we make no promises about the service beyond those in these terms — including about the accuracy of place information, or that a place will be open, suitable or to your liking.

To the extent the law allows, we are not liable for indirect or consequential losses, and our total liability to you for any claim related to the service is limited to the greater of (a) the amount you paid for Burge Premium in the 12 months before the claim and (b) US$50.

Nothing in these terms limits or excludes liability that cannot be limited or excluded by law — including liability for intent or gross negligence, for death or personal injury caused by negligence, or your statutory rights as a consumer in the country where you live.

13. Additional terms for the App Store version

If you downloaded Burge from the Apple App Store, you and we acknowledge that:

  • these terms are between you and us only, not Apple, and we — not Apple — are solely responsible for the app and its content;
  • Apple has no obligation at all to provide maintenance or support for the app;
  • if the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price for the app (if any); to the maximum extent the law allows, Apple has no other warranty obligation for the app;
  • we, not Apple, are responsible for addressing any claims by you or a third party relating to the app or your use of it, including product liability claims, claims that the app fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws;
  • if a third party claims that the app or your use of it infringes their intellectual property rights, we, not Apple, are solely responsible for investigating, defending, settling and discharging that claim;
  • you represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties;
  • you must comply with applicable third-party terms when using the app, such as your mobile data agreement;
  • Apple and its subsidiaries are third-party beneficiaries of these terms and, once you accept them, Apple may enforce them against you as a third-party beneficiary.

14. Governing law and disputes

These terms are governed by the laws of the Republic of Türkiye. If you live in another country, you keep the protection of any mandatory consumer law of that country, and you may bring a claim in the courts where you live where that law allows it.

15. Changes to these terms

We may update these terms, for example when we add features or the law changes. The “Last updated” date at the top shows when they last changed. If a change is significant, we will tell you in the app or on the website before it takes effect. If you keep using Burge after a change takes effect, the updated terms apply; if you don’t agree, you can stop using Burge and delete your account.

If any part of these terms turns out to be unenforceable, the rest still applies.
